NPS pensions for the employees of the State Government
The Gujarat Civil Service (Pension) Rules, 2002 at No. (1) under Article 12 provide for pensions for the employees of the State Government. The Government of India notification dated 22.12.2003 at number (2) under reading has made the new enhanced pension scheme applicable to the Central Government employees appointed on or after 01.01.2004. The resolution dated 18.03.2005 of this department on number (3) under the reading covered the State Government employees regularly appointed on or after 01.04.2005 under the new enhanced pension scheme. Government of India's Office Memorandum dated 05.05.2009 on No. (4) under reading, from the date on which the new Enhanced Pension Scheme came into force (from 01.01.2004) to the employees of the Central Government as per disability pension and family pension in case of death in service. Rules for Enhanced Pension Scheme have been framed.
Various State Employees' Associations have made submissions on Government of India basis to provide benefits as per disability pension and family pension in case of death in service to the employees under the State Government's new Enhanced Pension Scheme, which was under active consideration by the Government.
Resolution:
After mature consideration Government of India vide Office Memorandum dated 05.05.2009 under New Enhanced Pension Scheme provides benefits as per disability pension and family pension in case of death in service to officers/employees covered under New Enhanced Pension Scheme of State Government dated 01 ,04,2005 Disability Pension as per Rule-52 to 64 of the Gujarat Civil Service (Pension) Rules, 2002 and in case of death while in service Gujarat Civil Service (Pension) subject to the provisions of Rule-149 to 157 of the Gujarat Civil Service (Pension) Rules, 2002 The Family Pension Scheme under Rules, 2002 provides for the provision of benefits as per Family Pension under Rules-87 to 94 of 1972.
Officials/Employees covered under the new Enhanced Pension Scheme of the State Government whether they wish to receive benefits under the Gujarat Civil Service (Pension) Rules, 2002 as per Disability Pension and Family Pension in case of death while in service is hereby notified as per Form-A enclosed with this resolution. The option has to be given to the head of their office within three months from the date of occurrence, which has to be noted in the Sevapothi. The concerned officers/employees shall furnish the family details in Form-13 prescribed under Rule-89 of the Gujarat Civil Service (Pension) Rules, 2002 along with the option.
After the promulgation of this resolution, the officer/employee joining the new enhanced pension scheme of the state government will have to give a sadar option at the time of joining the new enhanced pension scheme. Which will be noted in Sevapothi.
Officers/Employees of State Government/Panchayat/Grant in Aid Institutions regularly appointed under the New Enhanced Pension Scheme dated 01.04.2005 or thereafter whose Permanent Pension Account Number (PPAN) Director, Pension &
